As a Louisiana Civil Law Notary, I often work with families after a loved one has passed away. One of the most important documents we prepare is the Affidavit of Heirship.
Simply put, it is a sworn statement written under oath that formally identifies the legal heirs of someone who has died.
For successions is it usually signed by two or more people who knew the deceased and are familiar with their family history. They swear to facts like the date and place of death, whether the person was married, and the names and relationships of all legal heirs.
An affidavit outside of the court system may only requite the signatures of the heirs themselves.
The Affidavit of Heirship is versatile, but its primary function is to provide proof of ownership and relationship, sometimes within a formal court process and sometimes outside of the courts reach.
Uses outside of the course reach include moving property through the OMV and asset transfers for beneficiaries of financial accounts.
In short, the Affidavit of Heirship is a crucial document that brings efficiency and clarity to the process of settling an estate & other accounts. It’s the sworn proof that helps families move forward, ensuring property and assets pass smoothly to the right people.
